1 – Definitions
When used in these terms and conditions in capital letters, the following terms shall have the meaning set out below:
"Domaine de la Brèche": Vendor, simplified joint-stock company with capital of 10,000 Euros, registered under the number 329 208 896 with the register of trade and companies of ANGERS, whose registered office is located: 5 Impasse de la Brèche, Varenne on the Loire, 49730.
"CLIENT (S)": Non-professional client (s) within the European Economic Area;
"STAY (S)": Stay (s) rental (s) designed and sold by Le Domaine de la Breche, destination(s) CLIENT (S);
"SITE": Domaine de la Brèche website - www.domainedelabreche.com
2 – Domain and territoriality of the offer
The offer of your STAY(S) are exclusively reserved for individuals. Domaine de la Brèche reserves the right to change, at any time and without notice, the STAY(S) offered in its paper and electronic catalogs.
3 – Orders
3.1. To book a stay, the CLIENT must be a capable adult.
3.2. In accordance with the provisions of Article L.113-3 of the Consumer Code and Articles L.211-8 and L.211-9 of the French Tourism Code, these general conditions are made available to any CLIENT, informative title and prior to the conclusion of any sales contract of STAY (S). They can also be obtained upon written request to Camping Domaine de la Breche 49730 Varennes sur Loire.
3.3. Each CUSTOMER acknowledges having read these general conditions prior to any reservation of a STAY, for himself/herself and for any person participating in the STAY.
3.4. The CLIENT places their order on the SITE or by telephone at the following number: +33 (0) 241512292. Any order of STAY entails an expressed acceptance by the CLIENT of the tariffs and these general conditions.
3.5. In case of conversing by telephone with Domain of the Brèche, we will send to the CUSTOMER a written offer which will be return signed, thus validating the order. If it is the CUSTOMER who has the initiative to contact the Domaine de la Brèche by telephone, the verbal agreement of the CLIENT is sufficient to validate the order.
3.6. On the SITE, the booking of a STAY can only be recorded if the CLIENT is clearly identified. The order is concluded only if the CLIENT has been able to check it in detail and correct any errors before confirming it.
The validation of the order is materialized by a "double click" (two mouse clicks):
- the first click validates the order;
- the second click confirms the order definitively after having checked it and, if necessary, corrected.
An email will be sent to the CLIENT.
3.7. To be valid, the order must specify in particular the references of the STAY (S), including the place (s) and date (s), as well as the agreed price, the terms of payment.
3.8. After the cashing of the total amount or a first deposit of the order, the CUSTOMER will receive by email an order confirmation, summarizing the details of the Domaine de la Brèche, the details and the number of his order, the modalities of payment.
3.9. Right of withdrawal: The Domaine de la Brèche wishes to remind that under Article L. 121-20-4-2 of the Consumer Code, the right of withdrawal does not apply to accommodation services, transportation, catering and recreation provided on a specified date or period. So that all orders made on our website or with one of our holiday advisors cannot be the subject of a right of withdrawal.
4 – Availability
Each STAY can be booked within the limits of the places available on the campsite.
In case of unavailability of the STAY, Domaine de la Brèche will inform the CLIENT in writing within three (3) working days from the date of validation of the order.
If necessary, the Domaine de la Brèche will propose in writing to the CLIENT an equivalent STAY which they can accept or refuse also in writing.
Upon receipt of the CUSTOMER's written refusal of an equivalent STAY, or in the absence of an offer of STAY equivalent to the date of the writing informing him of the unavailable STAY, their order will be cancelled and they will be reimbursed for the sums paid without delay and at the latest within fourteen (14) days.
5 – Capacity
The number of people indicated per accommodation in our rates corresponds to the maximum occupancy allowed given the equipment available. It cannot be exceeded for security and insurance reasons. The management reserves the right to refuse you access to the accommodation if the number of people exceeds the maximum allowed occupancy.
6 – Cancellation and modification of the stay
6.1. Any request from the CUSTOMER to modify or cancel the STAY must reach the Domaine de la Brèche by registered letter with acknowledgment of receipt. The deadlines mentioned below are valid from the date of receipt of this letter, the postmark being taken as proof.
The cancellation or modification of the STAY will result in the collection of at least the following costs:
* Beyond 30 days before the beginning of the STAY: 30% of the price of the STAY + the expenses of file + the expenses of insurance (if subscribed);
* From 30 to 15 days before the beginning of the STAY: 50% of the price of the STAY + the expenses of file + the expenses of insurance (if subscribed);
* From 14 to 8 days before the beginning of the STAY: 75% of the price of the STAY + the expenses of file + the expenses of insurance (if subscribed);
* Less than 8 days before the beginning of the STAY: 100% of the price of the STAY + the administration fees + the insurance fees (if subscribed)
6.2. Any modification or cancellation of the stay by Domaine de la Brèche more than three (3) working days after the date of validation of the order will be indicated without delay to the CUSTOMER by registered letter with acknowledgment of receipt request.
The CLIENT may:
- either accept the modification or the substitute STAY of an equivalent cost possibly proposed by the Domaine de la Brèche; if the amounts paid by the CUSTOMER exceed the price of the modified or substitute STAY, the surplus will be returned to them without delay and at the latest within fourteen (14) days following their written acceptance;
- or obtain the refund of the sums paid without delay and at the latest within fourteen (14) days following the cancellation by Domaine de la Brèche or the reception of their written refusal of modification of the STAY.
In the event of a cancellation by Domaine de la Brèche not attributable to force majeure, according to the definition resulting from established jurisprudence, or to a fault of the CUSTOMER, they will receive compensation equal to the penalty which would have been paid according to Article 5.1.
7 – Insurance
7.1. Domaine de la Brèche offers the CUSTOMER to take out a cancellation guarantee and interruption of optional stay.
The CLIENT must ensure that any claim is declared to Domaine de la Brèche within five (5) working days following the event resulting in the guarantee.

7.2. The Domaine de la Brèche is insured for its professional civil liability by society

The purpose of this contract is to guarantee Domaine de la Brèche against the pecuniary consequences of its Professional Civil Liability in connection with the sale of STAYS.
7.3. It is specified that no insurance for the CUSTOMER's Civil Liability is included in the price of the STAY(S) presented on the SITE. Domaine de la Brèche thus strongly encourages its CUSTOMERS to check their personal insurance coverage, if necessary to supplement it by the subscription of a complementary contract with their insurer, in view of the reserved stay.
8 – Price and billing
The STAY(S) are sold at the prices in effect at the time of placing the order, indicated in euros, following a dual display, in euros H.T. and euros T.T.C., and taking into account the T.V.A applicable on the day of the order.
Domaine de la Brèche reserves the right to modify the prices displayed on the SITE at any time but agrees to apply the rates in effect that have been indicated to the CLIENT at the time of order.
The prices listed on the WEBSITE include the rental for the period and the number of persons indicated in the offer of Domaine de la Brèche and, unless otherwise stated in the descriptions, include the following services: water, gas, electricity, the location for one vehicle per rental, access to reception facilities, entertainment and toilets. The rentals are fully equipped. For more details on their equipment, the arrival and departure times, as well as the deposit, please refer to the descriptions of rentals provided on the SITE.
The prices indicated on the SITE do not include: taxes of stay, the activities paying by the camp-site, the additional persons, the pets, the hiring of the sheets (except in the luxurious hirings), the bicycles, the safes, a baby kit (except in luxury rentals), etc. These additional services must be paid directly to the campsite.
The prices indicated on the SITE do not include, in any case, the transport costs.
After full payment of the stay, Domaine de la Brèche will give the CUSTOMER by mail or e-mail an invoice worth exchange voucher. The CUSTOMER will give this invoice on arrival at the campsite to have his STAY.
9 – Terms of payment
9.1 Four (4) payment methods are offered to the CLIENT:
1 / by credit card (Carte Bleue, VISA, or Master Card) online on the SITE (secure payment);
The information related to the CUSTOMER's credit card, (the sixteen-digit number of the credit card, the four digits of the expiry date, the last three digits of the security number on the back of the payment card) will be fully protected and encrypted SSL, via the secure payment platform Payzen.
Domaine de la Brèche will in no way use the card number of the CLIENT, except to obtain the payment of the order.
2 / by cheque, completed, signed and denominated in euros to the order of SAS ETANG DE LA BRECHE,
3 / ANCV Holiday vouchers can only be used for STAYS in France (including Dom-Tom) and the member countries of the European Union, sent within ten days of the order to Domaine de la Brèche - 5 Impasse de the Brèche, 49730, VARENNES SUR LOIRE - France. Failing this period, the order will be cancelled;
4 / by bank transfer to the bank account of Account owner :

9.2 In case of payment by transfer, bank cheques or holiday vouchers, the order is only pre-registered. The amount of the order must be credited to the account of Domaine de la Brèche within a maximum of five (5) working days from the order. Otherwise, the order will be cancelled.
9.3 Payment of an accepted order at least thirty days before the start of the STAY: Domaine de la Brèche provides the CUSTOMER with payment facilities in the case where the order has been accepted at least 30 days before the start date. The CLIENT, if they wish, can benefit from a payment in two (2) times:
- a first payment, with the order, equal to 30% of the price of the STAY + the expenses of file + the expenses of insurance (if subscribed).
- a second payment equal to 70% of the price of the STAY to be paid, at the latest, 30 days before the start date of the STAY. In case of payment by credit card, the CLIENT will not have to intervene, the payment of the balance being automatically programmed thirty (30) days before the beginning of the STAY.b
In the event that the balance of a STAY has not arrived within the time limits indicated above, the STAY is considered as cancelled and the conditions of cancellation in article 5 applies.b
9.4 Payment of an accepted order less than thirty days before the start of the stay:
Any booking of a STAY made less than thirty (30) days before the date of the beginning of the STAY must be paid in full by one card or bank transfer.
10 – Customer Service

Any eventual complaint following a STAY must be formulated in writing and sent by registered letter with acknowledgment of receipt, at the latest within twenty (20) days following the end of the STAY, the postmark being taken as proof.

10.2. In case of a disagreement between the CLIENT and Domaine de la Brèche on the assumption of its claim, in a timeframe of less than one year after the CUSTOMER made a written claim to Domaine de la Brèche, the CLIENT has the right to resort MEDICYS mediation services offered by Domaine de la Brèche.

The mediation is free for the CUSTOMER, except for lawyers, experts or any other person whom the CLIENT chooses to involve in the mediation.
In addition, the European Commission has set up a dispute resolution platform to collect any consumer complaints following an online purchase and to forward them to the relevant national ombudsmen.

11 – Protection of personal data
Some information and data concerning the CLIENT, is collected on the SITE for the needs of the management of the order. They can be transmitted to the partners of Domaine de la Brèche, responsible for the processing and execution of orders. This information and data is also kept for security purposes, in order to comply with legal and regulatory requirements.
The CLIENT is informed of this automated processing of information. This file is the subject of a declaration to the CNIL n ° 54165. Pursuant to Law No. 78-17 of 6 January 1978 as amended, the CUSTOMER has the right to oppose, access, modify, rectify and delete personal data concerning him at any time. on the SITE, in the section »My account» and by identifying with his password, or by writing to Domaine de la Brèche: contact@domainedelabrèche.com or: Camping Domaine de la Brèche, 5 Impasse de la Brèche, 49730 Varennes-sur-Loire FRANCE
12 – Liability
12.1 Exemption from the CLIENT:
Without news from the CUSTOMER 24 hours after their estimated date of arrival, Domaine de la Brèche may have its rental accommodation or its location. Domaine de la Brèche will retain the applicable fees in the event of cancellation under the conditions set out in Article 5.
In case of late arrival, or early departure, in relation to the dates mentioned on the invoice sent to the CUSTOMER (voucher), no refund will be made unless insurance provided for it was subscribed by the CLIENT.
12.2 Exemption by a third party:
The campsite owns and benefits from the rights of use of all the documents provided. The campsite guarantees the authenticity of the information and its character neither misleading nor lying. All documents provided must be legally free to use on the internet.
12.3 Exemption in case of force majeure:
Domaine de la Brèche cannot be held liable for non-performance of these terms and conditions in the event of force majeure as defined by established case law, including: internal or external power outages, or communications (network failure) computer, etc.), all natural disasters on the site of the STAY, including all floods, fire, storms, hail and other severe weather.
13 - Applicable rights
These general conditions are subject to French law.
The total or partial nullity of any clause hereof will not affect the validity of the other provisions.
14 - Children
The age of a child is calculated in relation to their birthday on the date of the beginning of the stay. An official document justifying the age of the children can be requested at the beginning of the stay.
Minors unaccompanied by their parents or a major legal guardian (close relative authorized, facilitator or supervising teacher) will not be allowed on the site for obvious reasons of safety (weather alert / severe bad weather, illness or hospitalization ...)
15 - Animals
Pets cannot move freely and must be kept on a leash. They are not allowed in the collective premises (restaurant, grocery shop, bar, swimming pools). Please indicate their presence when booking and bring their passport. 1st and 2nd category dogs are not allowed. A permit (participation) per day and per animal may be required.
They must have two conditions:
- valid anti-rabies vaccination
- identification by tattoo or chip certified by a map published by the Société Centrale Canine.
16 - Valuables
It is recommended not to leave valuables in the accommodation or on site unattended.
A safe is at your disposal at the reception of the campsite.
17 - Right to the image
You agree, openly and without compensation, that Domaine de la Brèche uses, for its promotional needs, the photographic and video supports of you or your children that could be taken during your stay.
18 - Arrivals / Departures
Arrival and departure times are determined for each type of accommodation. We thank you for respecting them to facilitate the work of our teams. In case of late arrival or last-minute emergencies, it is imperative to inform our services.
Rental: Arrival from 3pm and departure before 10am.
Camping pitches: arrival from 1pm and departure before 12pm
19 - Security deposit
Rental: A deposit of 300€ per occupied accommodation will be requested upon your arrival. This sum is payable by credit card or cheque payable to Domaine de la Brèche. It will be returned to you at the end of your stay, minus the cost, if any, of the damaged or missing equipment, or if any of the accommodation is not up to a satisfactory state of cleanliness.
20 - Cleaning in "rental"
Cleaning is your responsibility.
Household equipment is provided for this purpose. If you want to avoid the constraints of the last day and leave with peace of mind, a cleaning fee is offered (price per unit). To book a few days before your departure. Otherwise, if your accommodation is rendered in a state of cleanliness and unsatisfactory, we reserve the right to charge you a cleaning fee corresponding to the size of your accommodation.
21 - Wi-Fi
Wi-Fi is secure and free in some areas (bar) and some types of accommodation. For more information, please ask at the reception.
